Terms of Use
These Terms of Use (“Terms”) are a contract between you and McLean Reiter, an individual sole proprietor doing business as Daily HIIT (“Daily HIIT,” “we,” “us”), for the Daily HIIT iOS app and the website at dailyhiit.app. Daily HIIT is not a corporation, LLC, or partnership.
By creating an account or using Daily HIIT, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.
1. The service
Daily HIIT provides a programmed daily workout, an in-app class player, optional Apple Watch heart-rate features, and a membership to start class. Features may change. Some features need a compatible iPhone, and some need a paired Apple Watch and your permission to read Apple Health.
Daily HIIT is not medical care, diagnosis, or treatment.
2. Eligibility
You must be able to form a contract (generally 18 years or older in the United States). If you are 13–17, you may use Daily HIIT only with a parent or guardian’s consent and supervision. We do not knowingly create accounts for children under 13.
3. Accounts
You must sign in with a one-time code sent to a mobile number or email you control. You are responsible for that inbox or handset and for activity on your account. Give us accurate information. One person per account.
A phone number and an email currently create separate accounts. Do not expect purchases or history to move between them unless we later offer account linking.
We may suspend or close accounts that violate these Terms, look abusive, or create risk for other members or for us.
4. SMS login codes
If you enter your mobile number and request a code, you agree to receive automated transactional text messages with one-time login codes from Daily HIIT.
- Consent is limited to those authentication messages
- Frequency is low (when you request a code)
- Message and data rates may apply
- Reply STOP to opt out of SMS; reply HELP for help
- Carriers are not liable for delayed or undelivered messages
Opting out of SMS may prevent phone sign-in until you use another method we offer (such as email) or opt in again in the app.
5. Health and safety
Daily HIIT includes high-intensity interval training and strength work. Consult a physician before you start, especially if you are pregnant or have heart disease, high blood pressure, joint problems, or any other medical condition.
You participate voluntarily and at your own risk. Stop if you feel pain, dizziness, or shortness of breath beyond normal exertion.
Heart rate, calories, zones, and rings are estimates. They depend on your device, Watch fit, permissions, and the max-heart-rate value you provide. They may be wrong. They are not a medical device.
The in-app health disclaimer is part of these Terms. You must accept it before your first class.
6. Membership and Apple subscriptions
Starting class requires an active membership (paid subscription, intro trial, or complimentary access we grant).
Paid access is an auto-renewable subscription sold by Apple, not billed by Daily HIIT directly. Apple is the merchant of record.
- Payment is charged to your Apple ID at confirmation of purchase
- The length, price, and intro offer (including any free trial) are those Apple shows you at purchase
- The subscription renews automatically unless you cancel at least 24 hours before the end of the current period
- Your account is charged for renewal within 24 hours before the period ends
- You manage or cancel in iPhone Settings → [your name] → Subscriptions (or Apple’s current subscription settings)
- Uninstalling the app does not cancel the subscription
- After a trial, you will be charged unless you cancel before the trial ends
If Apple refunds or the subscription lapses, we may remove the ability to start class. You can still browse according to the product’s current rules.
Restore purchases in the app asks Apple to re-apply a subscription already tied to that Apple ID.
We do not guarantee a specific dollar price in these Terms; Apple’s storefront price controls.
7. Daily classes
There is one programmed class per local calendar day. After local midnight you cannot start the previous day’s class. If you start before midnight, that start still counts for that day even if you finish after midnight.
You may leave a class early. Unlimited attempts may be allowed; scoring and rings follow the in-app rules (including best attempt where applicable).
8. Acceptable use
You agree not to:
- Scrape, reverse engineer, or overload the service except as allowed by law
- Share your account or resell access
- Abuse SMS or email codes (including requesting codes for numbers you do not own)
- Interfere with other members or with our providers
- Use Daily HIIT for anything unlawful
Workout programming, copy, audio, design, and software are owned by the sole proprietor or our licensors. You get a personal, non-transferable license to use the app for yourself. You do not get ownership of the content.
9. Third parties
Apple, Supabase, Twilio, and email providers operate under their own terms. Apple Health data is also governed by Apple’s terms and your iOS permissions.
10. Disclaimers
DAILY HIIT IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that classes, metrics, notifications, or SMS will be uninterrupted, accurate, or error-free.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MCLEAN REITER (SOLE PROPRIETOR, D/B/A DAILY HIIT) IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF DAILY HIIT.
MCLEAN REITER’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID FOR DAILY HIIT MEMBERSHIP IN THE THREE MONTHS BEFORE THE CLAIM OR (B) TWENTY US DOLLARS ($20).
Some states do not allow certain limits; in those states our liability is limited to the fullest extent allowed.
This does not limit Apple’s responsibility as the App Store provider of In-App Purchases, which is governed by your agreement with Apple.
12. Indemnity
You will defend and indemnify McLean Reiter (sole proprietor, d/b/a Daily HIIT) from claims arising out of your misuse of Daily HIIT, your violation of these Terms, or your violation of law, except to the extent caused by our willful misconduct.
13. Termination
You may stop using the app at any time. Cancel Apple subscriptions separately in Settings. We may stop offering Daily HIIT or any feature. Sections that should survive (including 5, 10–12, 14) survive termination.
14. Governing law
These Terms are governed by the laws of the State of Washington, excluding conflict-of-law rules, and (where applicable) United States federal law. Courts located in Washington will have jurisdiction, except where prohibited.
15. Changes
We may update these Terms. We will revise the “Last updated” date and may notify you in the app. The current version is posted at https://dailyhiit.app/terms.html. If you continue to use Daily HIIT after the changes take effect, you accept the new Terms. If you do not agree, stop using the app and cancel any subscription.
